By using the Site, you affirm that you are over 18 years of age and agree to follow and be bound by these terms of use (the “Terms of Use”).  In these Terms of Use, the words “you” and “your” refer to each customer, Site visitor, “we”, “us” and “our” refer to LegalResident.com, LLC and “Services” refers to all services, software applications, materials, documents generated and content provided by us through your use of the Site.

It is your responsibility to review these Terms of Use periodically. If at any time you find these Terms of Use unacceptable or if you do not agree to these Terms of Use, please do not use this Site. We may revise these Terms of Use at any time. Your continued use of the Services will constitute your acceptance of the modified Terms of Service.

SOFTWARE AND MATERIALS ON OUR WEBSITE ARE NOT LEGAL ADVICE
LegalResident.com LLC is not a law firm and does not provide legal services.  Our Site provides an online portal to give visitors a general understanding of marriage-based immigration, software and educational materials to prepare their own legal documents.

At no time do we review your answers for legal sufficiency, draw legal conclusions, provide legal advice, opinions or recommendations about your legal rights, remedies, defenses, options, selection of forms, or strategies, or apply the law to the facts of your particular situation.  LegalResident.com LLC, the Site and our Services are not a substitute for the advice or services of an attorney. As a result, communications between you and LegalResident.com LLC are protected by our Privacy Policy, but not by the attorney-client privilege or as work product.

Attorneys are trained in the law and can help prevent a case from being denied, the immigrant from being deported and either party to the case from inadvertent self-incrimination.  Attorneys do this through careful case preparation, filing an entry of appearance and communicating with government agencies on behalf of their clients.  You are voluntarily assuming several risks if you do not hire a privately retained attorney to provide full-scope legal services.

USERS ARE RESPONSIBLE FOR THE ACCURACY OF IMMIGRATION FORMS

Our Site does not produce immigration forms that are 100% percent correct or complete, and immigration forms generated by the Site are populated with several default settings (or assumed answers appropriate for the majority of cases but not based on user input).  Click here to view the default settings and learn why we use them. The forms can be easily edited post download to fit your particular needs.

YOU AGREE TO READ THE FINAL IMMIGRATION FORMS BEFORE SIGNING THEM AND AGREE TO BE SOLELY RESPONSIBLE FOR THE ACCURACY OF THE IMMIGRATION FORMS.

While we promptly update the immigration forms as new editions are published by the government, users must check the form edition is valid as of the time of filing, not the date of download.

We make no representations about the suitability, reliability, availability or accuracy of the software, products, technical Services or immigration forms produced on this Site.  To the maximum extent permitted by law, all are provided “as is” without warranty of any kind. We hereby disclaim all warranties express or implied, including implied warranties of merchantability and fitness for a particular purpose and non-infringement, with respect to our Site and our Services.

INDEPENDENT ATTORNEY ADVERTISING AND INTEGRATION

One or more attorneys or law firms may from time to time advertise on our Site and may integrate with our site to use our software in connection with the delivery of legal services. However, each attorney or law firm acts independently from us.  We make no representation with respect to the quality or sufficiency of legal services they provide.

An attorney-client relationship can only be established pursuant to an agreement made directly with the individual attorney or law firm.   

LIMITATION OF LIABILITY

EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD LEGALRESIDENT.COM, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING ATTORNEY’S FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THIS AGREEMENT AND ANY VIOLATION BY YOU OF ANY FEDERAL, STATE, OR LOCAL LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF LEGALRESIDENT.COM, LLC HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF LEGALRESIDENT.COM, LLC, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. 

CHOICE OF LAW AND VENUE CLAUSE

You agree that these Terms of Use shall be treated as though executed and all Services performed in Austin, Texas, and shall be governed by the laws of Texas. You submit to the personal jurisdiction of, and agree that any claim or dispute you may have against LegalResident.com, LLC must be resolved by the courts located in located in Travis County, Texas, USA.

The laws of the State of Texas, USA govern the interpretation of these Terms of Use, regardless of conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods (1980) and the Uniform Computer Information Transactions Act (UCITA) are hereby excluded in their entirety from application to these Terms of Use.

These Terms of Use, and all claims or causes of action (whether in contract, tort or statute) that may be based upon, arise out of or relate to these Terms of Use, the use of our Site, or the negotiation, execution or performance of these Terms of Use (including any claim or cause of action based upon, arising out of or related to any representation or warranty made in or in connection with these Terms of Use or as an inducement to agree to these Terms of Use), shall be governed by, and enforced in accordance with, the internal laws of the State of Texas, including its statutes of limitations.

CLASS ACTION WAIVER
Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity. No proceeding will be combined with another without the prior written consent of all parties to all affected proceedings. YOU ARE GIVING UP YOUR RIGHT TO PARTICIPATE AS A CLASS REPRESENTATIVE OR CLASS MEMBER ON ANY CLASS CLAIM YOU MAY HAVE AGAINST US INCLUDING ANY RIGHT TO CLASS ARBITRATION OR ANY CONSOLIDATION OF INDIVIDUAL ARBITRATIONS.

THE SITE IS FOR PERSONAL USE ONLY 

It may be a crime to assist another person to prepare immigration forms if you are not an attorney or a legally authorized representative, and that activity is strictly prohibited on our Site.  You agree that you will only use our Site to prepare immigration forms for yourself. To help prevent the abuse of our software, user accounts are limited to eight (8) merges/ downloads per payment.

POSSIBILITY OF DATA/ SECURITY BREACH

We have taken precautions to protect the security of user accounts. However, you agree not to input any information onto the Site that may cause financial harm, personal embarrassment or any other damage in the event of a data breach or inadvertent loss or theft of the information.  Users are not required to input sensitive information, such as social security numbers, on the Site; these may be added to the government forms after download. You agree not to use our Site over a shared Wifi connection or on a public or shared computer.  You also agree to manually log out of the Site with two clicks and close the browser windows (this is the only way to effectively log out).  You agree to use a strong and secure password and protect the integrity of your email account for password resets.  You agree to delete your account after use, so that your information is further protected.

SEVERABILITY AND REFORMATION

Each provision of these Terms of Use is a separately enforceable provision. If any provision of these Terms of Use is determined to be or becomes unenforceable or illegal, such provision will be reformed to the minimum extent necessary in order for these Terms of Use to remain in effect in accordance with its terms as modified by such reformation.

PRIVACY POLICY

We use “cookies” on this site and all affiliate sites owned by us. A cookie is a piece of data stored on a site visitor’s hard drive to help us improve your access to our site and identify repeat visitors to our site. For instance, when we use a cookie to identify you, you would not have to log in a password more than once, thereby saving time while on our site. Cookies can also enable us to track and target the interests of our users to enhance the experience on our site. Usage of a cookie is in no way linked to any personally identifiable information volunteered on our site.

Our website uses Google’s remarketing technology. This allows us to display relevant ads based on what pages on the website you have viewed. The advertising will be displayed using cookies. This cookie doesn’t record any personal information or identify you personally.

We may from time to time use Facebook Advertising, Facebook Pixel Re-Marketing, and communications. This tool allows us to understand and deliver ads and make them more relevant to you. The collected data remains anonymous and we cannot see the personal data of any individual user.

However, the collected data is saved and processed by Facebook. Facebook may be able to connect the data with your Facebook account and use the data for their own advertising purposes (in accordance with Facebook’s Data Use Policy found under: https://www.facebook.com/about/privacy/). Facebook has ultimate control of the information gathered through Facebook Advertising, Facebook Pixel Re-Marketing, and communications.
