By using the LegalResident.com website (the “Site”), you agree to follow and be bound by these terms of use (the “Terms of Use”) and agree to comply with all applicable laws and regulations, including United States export and re-export control laws and regulations. In these Terms of Use, the words “you” and “your” refer to each customer, Site visitor, “we”, “us” and “our” refer to LegalResident.com and “Services” refers to all services provided by us through your use of the Site.

It is your responsibility to review these Terms of Use periodically. If at any time you find these Terms of Use unacceptable or if you do not agree to these Terms of Use, please do not use this Site or any Applications. We may revise these Terms of Use at any time without notice to you.

THE SOFTWARE AND MATERIALS ON OUR WEBSITE ARE NOT LEGAL ADVICE
LegalResident.com provides an online portal to give visitors a general understanding of the law and to provide an automated software solution to individuals who choose to prepare their own legal documents, or individuals who use the Site at the direction of their privately retained attorney not affiliated with LegalResident.com.

At no time does LegalResident.com review your answers for legal sufficiency, draw legal conclusions, provide legal advice, opinions or recommendations about your legal rights, remedies, defenses, options, selection of forms, or strategies, or apply the law to the facts of your particular situation. LegalResident.com, its Services, and its forms or templates are not a substitute for the advice or services of an attorney.

SERVICES ARE STRICTLY LIMITED IN SCOPE

Our Services are strictly limited to generalized educational information and form generation. Users without a privately retained attorney are urged to hire one to assist them with their case preparation and submission.  Attorneys are trained in the law and can help prevent a case from being denied, the immigrant from being deported and either party to the case from inadvertent self-incrimination.  Attorneys do this through careful case preparation, filing an entry of appearance and communicating with government agencies on behalf of their clients.  You expressly acknowledge that you are taking several risks if you do not hire a privately retained attorney to provide full-scope legal services to you.

USERS AND THEIR ATTORNEYS ARE RESPONSIBLE FOR THE ACCURACY OF IMMIGRATION FORMS

Our software does not produce forms that are 100% percent correct or complete, and forms generated by the Site are subject to several default settings. Users, and their attorneys if any, must review and edit the forms after download and prior to submission to the government.

While we promptly update the forms as new editions are published by the government, users must check the form edition is valid as of the time of filing, not the date of download.

Since the law changes rapidly, LegalResident.com cannot guarantee that all of the information on the Site is completely current. The law is different from jurisdiction to jurisdiction, and may be subject to interpretation by different courts. The law is a personal matter, and no general information or legal tool like the kind LegalResident.com provides can fit every circumstance. Furthermore, the legal information contained on the Site is not legal advice and is not guaranteed to be correct, complete or up-to-date.

We make no representations about the suitability, reliability, availability or accuracy of the software, products, technical Services or immigration forms produced on this Site.  To the maximum extent permitted by law, all are provided “as is” without warranty of any kind. We hereby disclaim all warranties express or implied, including implied warranties of merchantability and fitness for a particular purpose and non-infringement, with respect to our Site and our software Services.

DEFAULT SETTINGS OF THE SITE SOFTWARE

Our software has several default settings.  The user, or a privately retained attorney, can modify these default entries after download. For example, one default setting is on the Form I-130, and that default is set to reflect that the immigrant has never been in “proceedings” such as deportation or removal proceedings.  If the immigrant has been in “proceedings” this would need to be changed after downloading the form.

Several other default settings are employed.  Furthermore, you should not presume that the language of the software is 100% identical to the language on the government forms.  Each user, and their attorney if any, is responsible for reviewing the government forms after download and editing them as necessary so that they are true and correct as submitted  to the government.

THE SITE IS FOR PERSONAL USE ONLY OR AS DIRECTED BY A PRIVATELY RETAINED ATTORNEY

It may be a crime to assist another person to prepare immigration documents if you are not an attorney, and that activity strictly prohibited on our Site.  You agree that you will only use our Site to prepare immigration forms for yourself and for your own personal use, or that you will be working at the direction of an attorney licensed to practice United States immigration law, not subject to any order suspending, enjoining, restraining, disbarring or otherwise restricting him or her to practice United States immigration law.

To help prevent the abuse of our software, user accounts are limited to eight (8) merges/ downloads per payment.  In most cases, we believe, only one (1) merge/ download will be required.

POSSIBILITY OF DATA/ SECURITY BREACH

We have taken steps to protect the security of user accounts. However, you agree not to input any information onto the site that may cause financial harm, personal embarrassment or any other damage in the event of a data breach or inadvertent loss or theft of the information.  Users are not required to input sensitive information, such as social security numbers, on the Site; these may be added to the government forms after download. You agree not to use our Site over a shared Wifi connection or on a public or shared computer.  You also agree to manually log out of the Site with two clicks and close the browser windows (this is the only way to effectively log out).  You agree to use a reasonably strong password and acknowledge that the strength of your password, and ability access to your email account for password resets, directly affect the security of the information you enter on the Site.  You agree to delete your user account after you are finished using our Site, so that your information is further protected.

GENERAL TERMS & PRIVACY POLICY

To the maximum extent permitted by law, this agreement is governed by the laws of the State of Colorado, U.S.A. and you hereby consent to the exclusive jurisdiction and venue of courts in Denver, CO, U.S.A. in all disputes arising out of or relating to the use of our Site, information on our Site, or our form building software and Services.

We reserve the right, in our sole discretion, to terminate access to the site and delete your account without notice.

We use small data files placed on your computer called “cookies,” and similar software, so that we can recognize you when you return to our website and personalize and improve your user experience. You can manage the use of cookies through your browser settings.

We also use Google Analytics to help us improve and analyze use of our website and services and to re-market to site visitors . You can opt out of Google re-marketing through Google.

We use a pixel to use Facebook re-marketing.

SEPARATE ATTORNEY – CLIENT RELATIONSHIP

LegalResident.com and this Site are owned and operated by Michael McCarroll who is licensed to practice law in Colorado. He is not your attorney absent a separate written legal services agreement with him and payment in his discretion.

For users with an attorney-client relationship with Mr. McCarroll established by a separate written legal services agreement, or as determined by a court, these Terms of Use shall not be understood or construed in any way to prospectively limit Mr. McCarroll’s liability for malpractice.
